1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
"Chang Haven," "we," "our," "us" refers to Chang Haven, located at 112 Moo 3, Mae Rim-Samoeng Road, Mae Rim, Chiang Mai 50180, Thailand.
"Services" refers to the residential retreat programs, accommodation, meals, activities, and related offerings provided by Chang Haven.
"Guest," "you," "your" refers to any individual who uses our website, makes an inquiry, books a program, or stays at Chang Haven.
"Agreement" refers to these Terms and Conditions together with any booking confirmation or program-specific documentation provided to you.
2. Acceptance of Terms
By accessing our website, submitting a contact or booking form, or participating in any of our programs, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
You must be at least 18 years of age to use our services or enter into any agreement with Chang Haven. By engaging with our services, you confirm that you meet this age requirement and have the legal capacity to enter into binding agreements.
3. Description of Services
Chang Haven provides non-medical residential retreat programs for seniors in Chiang Mai, Thailand. Our current offerings include the Weekend Retreat Experience, the Seasonal Residential Program, and the Annual Community Membership. Specific details of each program, including inclusions and pricing, are available on our Solutions page.
Service availability is subject to capacity and seasonal factors. We reserve the right to modify program details, schedules, and availability with reasonable notice to affected guests.
4. Booking and Payment
Bookings are confirmed upon receipt of the required payment. The specific payment terms for each program are as follows:
Weekend Retreat: Full payment of ฿6,500 THB is due at the time of booking.
Seasonal Residential Program: Billed monthly at ฿24,500 THB per month, with the first month's payment due upon arrival.
Annual Community Membership: Billed monthly at ฿38,500 THB per month, with one month's advance payment due upon enrollment.
All prices are quoted in Thai Baht (THB). We accept bank transfers and major credit cards. Payment processing fees, if applicable, are the responsibility of the guest.
5. Cancellation and Refunds
Weekend Retreat: Cancellations made at least 7 days before the scheduled arrival date are eligible for a full refund. Cancellations made within 7 days of arrival may receive a 50% refund or credit toward a future stay, at our discretion.
Seasonal and Annual Programs: A written cancellation notice of at least 30 days is required. Early departure from a seasonal or annual program does not entitle the guest to a refund for the remaining period unless exceptional circumstances apply and are agreed upon in writing.
Refunds, when applicable, will be processed within 30 business days to the original payment method.
6. Guest Responsibilities
While staying at Chang Haven, guests are expected to:
Treat other residents, staff, and visitors with courtesy and respect. Comply with community guidelines regarding noise, shared spaces, and scheduled activities. Notify staff of any dietary requirements, health conditions, or accessibility needs that may affect their stay. Respect the property, furnishings, and surrounding environment. Refrain from activities that may endanger themselves or others. Follow Thai law during their stay.
Chang Haven is a non-medical community. Guests must be able to manage their daily activities independently or with minimal non-medical assistance. We reserve the right to decline or discontinue service if a guest's needs exceed what we can safely provide.
7. Intellectual Property
All content on our website — including text, images, logos, design elements, and code — is the property of Chang Haven or its licensors and is protected under applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our website content without our prior written permission.
You are granted a limited, non-exclusive, non-transferable license to access and view the content on our website for personal, non-commercial purposes only.
8. Disclaimers
Chang Haven provides its services and website content on an "as is" and "as available" basis. While we strive to maintain high standards in all aspects of our operations, we do not make specific promises about the outcomes of your stay.
Chang Haven is not a medical facility and does not provide medical, nursing, or therapeutic services. Nothing in our programs should be considered a substitute for professional medical advice or treatment. We strongly encourage guests to maintain their regular medical consultations and to carry adequate travel and health insurance during their stay.
9. Limitation of Liability
To the fullest extent permitted by Thai law, Chang Haven shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or website. Our total liability for any claim relating to our services shall not exceed the amount you have paid for the specific program giving rise to the claim.
This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability for gross negligence or willful misconduct.
10. Indemnification
You agree to indemnify and hold harmless Chang Haven, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of our services, or your conduct during your stay.
11. Termination
Either party may terminate the service agreement by providing written notice as specified in Section 5 (Cancellation and Refunds). Chang Haven may also terminate or suspend services if a guest materially breaches these Terms, engages in behavior that is harmful to other residents or staff, or if circumstances arise that make continued service impractical.
Upon termination, the guest is responsible for any outstanding payments for services already rendered. Provisions relating to liability, indemnification, and governing law shall survive termination.
12. Force Majeure
Chang Haven shall not be held liable for delays or failure to perform obligations due to events beyond our reasonable control, including natural disasters, government actions, epidemics, civil unrest, or disruptions to essential services.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. If a resolution cannot be reached within 30 days of written notice of the dispute, either party may proceed with legal action.
14. General Provisions
Entire Agreement: These Terms and Conditions, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Chang Haven.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
Assignment: You may not assign or transfer your rights under these Terms without our written consent. Chang Haven may assign its rights and obligations without restriction.
15. Changes to These Terms
We may revise these Terms and Conditions from time to time. Updated terms will be posted on this page with a new "Last Updated" date. Continued use of our website or services after changes have been posted constitutes your acceptance of the revised terms.
